The terms for using Prohor
These terms cover prohor.day and the Prohor app at app.prohor.day while Prohor is in early access. They are written to be read. By creating an account, you agree to them. If you do not agree, please do not create one.
Who you are dealing with
Prohor is made by Shaif Arfan, an individual in Bangladesh. "We" on this page means Shaif Arfan. Write to privacy@prohor.day about anything here.
Early access
Prohor is free and invite-only while it is in early access. An invite is for one person, and an account is not to be shared. There is no date for when Prohor opens to everyone, and none is promised.
Things will change, and some will break. We may add, change or remove features at any time. That is what early access is for, and when something breaks we would like to hear about it.
Your account
You need to be 18 or older to have an account. Give us accurate details, use an email address that is yours, and keep your password to yourself. Tell us straight away if you think someone else has got into your account. You are responsible for what is done with it.
Your data is yours
You own everything you put into Prohor ("your content"). You give us a free, worldwide, non-exclusive licence to use it for one purpose only: to store it, sync it between your devices, back it up, show it back to you, and keep the service running and secure. This licence ends when your content is deleted, apart from copies in backups, which expire on their normal schedule.
We never sell your content and never use it for advertising. We do not read it, except to fix a fault you have reported, to keep the service secure, or because the law requires it.
The privacy policy says exactly what is kept and where. Please do not put things in Prohor that you would not want stored on a third-party server, such as passwords or government ID numbers.
Fair use
Use Prohor for your own day. Do not:
- use it to break the law or to harm or harass anyone;
- pretend to be someone else;
- try to get into accounts or data that are not yours;
- overload, attack or work around the security of the service;
- scrape it, copy it, or resell access to it;
- upload anything harmful, or anything you have no right to.
Prohor is not a system of record
Prohor helps you see where your time goes. It is not an accounting, billing, payroll, tax or legal record. If you rely on your time entries to invoice a client, pay someone or meet a legal duty, keep your own records as well.
What is ours
The Prohor name, logo, design and code belong to us. You get a personal right to use the service under these terms, and nothing more. If you send us ideas or feedback, we may use them without owing you anything.
Price
Prohor is free during early access. If that ever changes, you will be told well in advance, and you will not be charged anything unless you choose a paid plan yourself.
Leaving, and ending early access
You can stop using Prohor at any time, and ask us to delete your account and everything in it.
We can end early access, or Prohor itself, with 30 days' notice by email. In that time you can ask for a copy of everything in your account in a common format such as JSON or CSV, and you will get one.
We can suspend or close an account straight away if it is used in a way that breaks the fair use rules above, puts the service or other people at risk, or if the law requires it. Where we can, we will tell you why and give you a copy of your data.
No guarantees
Prohor is provided "as it is" and "as available", while it is being built. We work to keep it running and your data safe, but we cannot promise that it will always be available, free of mistakes, suited to a particular purpose, or that nothing will ever be lost. Keep your own copy of anything important, and ask us for an export whenever you want one.
Liability
As far as the law allows:
- we are not liable for indirect or consequential losses, or for lost profits, lost business, lost time or lost data, that come from using Prohor or from not being able to use it; and
- our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim and 5,000 Bangladeshi taka.
Nothing in these terms limits a liability the law does not allow to be limited, such as liability for fraud, or takes away your rights as a consumer where you live.
Your responsibility
If a third party makes a claim against us because of your content, or because you broke these terms, you agree to cover the reasonable costs that come from it, as far as the law allows. This does not apply where we caused the problem.
Which law applies
These terms are governed by the laws of Bangladesh. If we disagree, write to privacy@prohor.day first and we will try to sort it out within 30 days. If that fails, disputes go to the courts of Dhaka, Bangladesh, unless the law where you live gives you the right to bring a claim in your own courts.
Changes to these terms
The date at the top says when these terms last changed. If a change matters, account holders are told by email at least 14 days before it takes effect. Using Prohor after that means you accept the new terms. If you do not, stop using it and ask us to delete your account.
The rest
If a part of these terms turns out to be unenforceable, the rest still applies. If we do not enforce a right straight away, we have not given it up. These terms and the privacy policy are the whole agreement between you and us about Prohor.
We may hand Prohor and these terms over to another person or a company that runs it later, for example if we set one up. We will tell you by email first, and your rights will not be reduced. You may not hand over your account.
